Welcome to Vaulternal. These Terms of Service ("Terms") govern your use of our blockchain-based digital legacy storage service. By using our service, you agree to these terms.

1. Acceptance of Terms

By accessing or using Vaulternal's services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not access the service.

2. Description of Service

2.1 Core Service

Vaulternal provides a blockchain-based digital legacy storage platform that allows users to:

  • Store digital assets, messages, and data securely using zero-knowledge encryption
  • Set automated trigger conditions for data release
  • Designate beneficiaries for their digital legacy
  • Manage and update vault contents and conditions

2.2 Service Limitations

Our service is subject to:

  • Blockchain network availability and performance
  • Technical limitations of distributed storage
  • Smart contract functionality and network fees
  • Regulatory compliance requirements

2.3 Early Access

Vaulternal is currently in Early Access. During this period:

  • Features may change, be removed, or work differently without prior notice
  • The service may experience bugs, downtime, or unexpected behavior
  • We do not guarantee feature availability, performance levels, or data permanence

We are committed to delivering the best possible experience. During Early Access, we actively improve the platform based on user feedback and appreciate your patience as we refine and enhance our service.

3. User Accounts and Registration

3.1 Account Creation

To use our service, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for:

  • Safeguarding your private keys and recovery phrases
  • Maintaining confidentiality of your login credentials
  • Immediately notifying us of any unauthorized access

Due to our zero-knowledge architecture, we cannot recover your encryption keys or access your encrypted data. Loss of your private key or recovery phrase may result in permanent loss of access to your encrypted files.

4. Acceptable Use Policy

You agree not to use our service to:

  • Store illegal, harmful, or offensive content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to breach or circumvent security measures
  • Interfere with or disrupt the service or servers

5. Payment Terms

5.1 Subscription Plans

Our subscription-based pricing includes:

  • Monthly or annual billing cycles
  • Monthly upload limits based on your chosen plan
  • Blockchain storage and transaction fees (included in subscription pricing)

5.2 Pricing Changes

We may change subscription pricing and monthly upload allowances at any time with 30 days' written notice. Because Vaulternal relies on third-party decentralized storage infrastructure (Arweave), upload fees may be adjusted to reflect changes in underlying network costs. Changes apply to the next billing cycle after the notice period. Your continued use of the service after the effective date of a pricing change constitutes acceptance of the new pricing. If you do not agree with a price change, you may cancel your subscription before the change takes effect.

5.3 Refunds and Cancellation

Subscriptions are generally non-refundable. You may cancel your subscription at any time; access to paid features continues until the end of the current paid period. We reserve the right to issue refunds at our sole discretion in cases of extended service unavailability.

6. Intellectual Property

You retain ownership of content you store in your vaults. We retain ownership of our platform, technology, and associated intellectual property rights. You grant us a limited license to process your encrypted data solely for the purpose of providing the service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DURING THE CURRENT EARLY ACCESS PERIOD, THE SERVICE MAY CONTAIN BUGS, EXPERIENCE DOWNTIME, OR BEHAVE UNEXPECTEDLY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VAULTERNAL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO VAULTERNAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

IN NO EVENT SHALL VAULTERNAL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE THEORY OF LIABILITY.

9. Indemnification

You agree to indemnify, defend, and hold harmless Vaulternal and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service, (b) your content stored on the platform, (c) your violation of these Terms, or (d) your violation of any third-party rights.

10. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the service will cease at the end of your current paid period
  • You may export your data before your access expires
  • We will delete your account data in accordance with our Privacy Policy and applicable data retention requirements
  • Any data that has been committed to blockchain storage cannot be deleted due to the immutable nature of blockchain technology

11. Changes to Terms

We may modify these Terms from time to time. We will provide at least 30 days' notice of material changes via email or through our service. Your continued use after the notice period constitutes acceptance of the updated terms. If you do not agree with changes, you may terminate your account before the changes take effect.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the service shall be resolved by the competent courts of the Czech Republic.
